Peter J. Famighetti

Peter is a passionate and dedicated advocate. Peter has represented clients in various forums, including the United States District Court for the Eastern and Southern Districts of New York, as well as in New York State Courts in the region. Throughout his career that has spanned more than a decade, Peter has served as defendants’ and Plaintiffs’ counsel in single and class action employment related litigation. Most recently, Peter won a jury trial on a First Amendment retaliation case in Federal Court. Additionally, Peter has appeared extensively in cases before arbitration tribunals and administrative agencies, including the New York State Division of Human Rights, the Equal Employment Opportunity Commission, New York City’s Office of Administrative Trials and Hearings, amongst others. Moreover, Peter has obtained numerous successful results for clients in other employment cases in court, arbitration, and mediation. Peter was listed in the 2014 Super Lawyers New York Metro Magazine.

Prior to entering private practice, Peter served as a Deputy County Attorney at the Office of the Nassau County Attorney. During his tenure as a Deputy County Attorney, he represented the County of Nassau and the County’s various departments and agencies in employment and labor related matters. Additionally, Peter was involved in contract negotiations between the County and the County’s various labor unions. Subsequent to his public service, and immediately prior to founding Famighetti & Weinick, Peter was employed as a Senior Associate at one of Long Island’s and New York City’s highly regarded employment law firms. During his years in private practice, Peter mainly represented clients in employment related matters, handling and managing a complex caseload.

Peter received his law degree from Hofstra University School of Law, and his undergraduate degree from the College of Management and School of Public Service from Long Island University, C.W. Post. Peter resides in Suffolk County with his wife Lauren and three boys Joseph, Justin and Jayden.

Notable Cases

  • Obtained determination that probable cause existed to believe that school district discriminated against client based on her disability. Defeated district’s attempts to have Commissioner of Human Rights overturn the determination.
  • Defeated individual defendants’ attempts to have court dismiss the state discrimination law claims asserted against them based on an unsettled issue of law in the jurisdiction.
  • Represented fired employee in arbitration against major U.S. airline resulting in client being returned to work.
  • Negotiated settlement of client’s disability discrimination claims for value nearly ten times client’s actual damages.
  • Won motion to dismiss all claims made by a plaintiff against client asserting ownership of client’s automobile dealership, one of the most successful dealerships in the country. Decision affirmed on appeal.
  • Brought claims on behalf of client, a high ranking police official, for First Amendment retaliation and disability discrimination. Defeated County’s motion to dismiss claims on summary judgment.
  • Represented terminated teacher in age discrimination case. Negotiated teacher’s return to work before ever needing to file a lawsuit.
  • Numerous other successful outcomes achieved for clients.
